The Plan is designed to comply with IRS Code requirements prohibiting discrimination in favor of highly compensated individuals regarding eligibility, contributions, and benefits. The Plan Administrator may exclude certain highly compensated individuals or limit contributions to ensure compliance with applicable nondiscrimination rules.
We maintain strict privacy and security protocols for all personally identifiable health information as required by law. While aggregate health data may inform program design, individual medical information is never disclosed publicly or shared with employers except as necessary for reasonable accommodations or as expressly permitted by law. Medical information cannot be used for employment decisions.
In accordance with the Mental Health Parity Act (MHPA) of 1996 and the Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA), this Plan applies uniform terms and enforces parity between covered physical health benefits and covered mental health/substance disorder benefits regarding financial restrictions and treatment limitations.
This self-funded benefit plan falls under the Employee Retirement Income Security Act of 1974 (ERISA). The Plan is funded with employee and/or employer contributions. Federal law and jurisdiction preempt state law where applicable.
